Nursing home abuse is a terrible crime. The victims, often elderly or mentally and physically disabled, have few defenses to this abuse. They are ill or infirm and lack the physical ability to prevent harm. Many may suffer from dementia or Alzheimer’s disease, and may not even fully recognize they are being abused. Others develop bedsores or other ailments related to neglect within the facility.
A man employed by a New York nursing home has been charged with endangerment and falsifying records. The nursing home abuse charges are a felony and he could be sentenced to up to four years in prison if convicted.
The man denied the incident, but a video camera recorded the worker following the disabled man into the dining room at the facility and pushing and punching him, and then leaving him on the floor. The disabled resident of the nursing home suffered injuries to this neck and buttocks.
If you have family member in a nursing home or long-term care facility you should always be aware of the potential for abuse. In this case, it was fortunate the abuse was captured on camera; otherwise, the man’s injuries may have been unexplained or simply assumed that he fell on his own.
It is important to pay attention to details in these facilities and be aware when incidents occur. Warning signs may include pressure ulcers, unexplained fractures, residents wandering off or dehydration.
If you suspect abuse, do not ignore it. Always ask questions and press for explanations, and if the explanations do not appear to add up, consider speaking with an attorney familiar with nursing home abuse cases. If necessary, they may investigate further if abuse or other wrongdoing appears to be taking place.
